IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 43 WRIT PETITION NO. 6907 OF 2024 Ankita Pralhadrao Kanle

VERSUS

The State Of Maharashtra Through Secretary And Another ...

Advocate for the Petitioner : Mr. Sunil Mahadevappa Vibhute AGP for Respondents: Mr. S.P. Joshi

CORAM

: MANGESH S. PATIL & SHAILESH P. BRAHME, JJ.

DATE : 08.07.2024 PER COURT :

The petitioner's proposal for validation of her tribe certificate is pending with respondent no. 2-scrutiny committee since September 2023. She is in urgent need of decision in view of the fact that she has appeared for NEET (UG)-2024 and secured good marks.

2.

We have heard both the sides.

3.

It is being pointed out by the learned advocate for the petitioner that in some earlier proceedings, conditional validities were granted subject to the final out come of the matters of the blood relatives, which the committee had decided to reopen. Pursuant thereto, show cause notice was issued to the first validity holder. However, subsequently, the committee itself dropped those notices, thereby confirming the validity of that individual to whom notice was issued.

4.

The learned advocate submits that subsequently, this Court has issued directions to the committee to issue certificates of validity to two blood relatives of the petitioner, including the real brother. He, therefore, submits 1/2

43 WP 6907 24.odt that there is nothing to be inquired into by the committee in view of the peculiar state of affairs. The validities issued to the blood relatives have become final and the committee can consider this aspect and validate petitioner's tribe certificate.

5.

We dispose of the writ petition by directing the committee, in the peculiar facts and circumstances brought to our notice by the learned advocate for the petitioner, to decide the petitioner's proposal within two weeks.
