The petitioner is aggrieved by the order passed by respondent no.1, thereby referring the dispute about apportionment of compensation of the house property to the Civil Court. Record indicates that respondent no.2 has claimed that he has interest in the acquired property.

In that view of the matter, respondent no.1 was right in referring the dispute to the Competent Civil Court. Since disputed question of facts are involved in the present petition and no illegality or perversity is found in the order impugned in the petition, the writ petition is dismissed. No costs.
