Heard the learned counsel for the applicants and the learned A.P.P. for the respondents.

The applicants seek bail in C.R.No.334 of 2024 registered with Ahamadpur Police Station, District Latur, for the offences punishable under Sections 302, 143, 147, 149 of the Indian Penal Code.

The first information report is silent about role attributed to the applicants. The crime was registered against the applicant.

955-BA-1132-24.odt The prosecution could not collect incriminating evidence against the applicants. Probably, they might be arraigned as an accused being brother of other co-accused. Since nothing is to be recovered from them, they deserve bail. Hence, the order :-

ORDER

i) Bail application is allowed.

ii) Applicants No.1 - Husen Faijoddin Shaikh and No.2 - Ramjan Ayub Shaikh be released on bail, on furnishing PB and SB of Rs.50,000/- each, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the condition that they shall attend the Police Station as and when called by the Investigating Officer on written notice.
