CA/9645/2024 has been filed to bring the legal heirs of deceased appellant No.1A on record. For the reasons stated in the application, the same is allowed and disposed of.

The State / Acquiring Body is permitted to bring the legal heirs of deceased appellant No.1A on record in the First Appeal filed by the Acquiring Body.

The learned counsel for the parties has placed on record the order in First Appeal No.2737/2010 and other connected matters dated 23/08/2024, wherein the appeals filed by the Acquiring Body as well as by the claimants were dismissed. He submits that the same would be Page 1 of

1002 CA 9645-2024 applicable to the facts of the present case, as the appeals arise out of the same acquisition proceedings and the Section 4 notification is the same, and the lands are similarly placed as in First Appeal No.2737/2010 and other connected matters.

In view of the same, First Appeal No.941/2011 and Cross-Appeal No.01/2015 are dismissed accordingly.

The amount deposited in this Court is permitted to be withdrawn by the applicants/claimants in terms of the order passed by the reference Court, along with accrued interest. 6.
