Heard Mrs. Chincholikar learned counsel appearing for the applicant, Mr. Chillarge, learned counsel appearing for the respondent No. 1 and Mr. Shinde learned A.G.P. for the respondents No. 2 and 3. 2.

This is an application for condonation of 544 days delay caused for filing appeal. From the reasons/grounds mentioned in the application it appears that, the applicant is a Minor Irrigation Division, working at Latur. It has to discharge various official duties being the officers of the Corporation including financial, administrative and implementation of the various schemes etc. It requires some time for advice and instructions from the Higher Authorities and also some time was consumed for getting court-fees. The learned counsel appearing for the respondents opposed this application.

For the reasons stated in the application, the delay caused for filing appeal is condoned.

Civil Applications are disposed of.

In the first appeal issue notice to the respondents. Mr. Chillarge, learned counsel waives notice for respondent No. 1 and learned A.G.P. Waives notice for respondents No. 2 and 3.

The learned counsels appearing for the parties are ready for final hearing. Since the similar issue is adjudicated in the connected matters, hence list this appeal for final hearing in the week commencing from 18.09.2017.
