IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD ANTICIPATORY BAIL APPLICATION NO.950 OF 2022 GOVIND BANDU KALE

VERSUS

THE STATE OF MAHARASHTRA ...

Advocate for Applicant : Mr. Sudarshan J. Salunke APP for Respondent : Mr. S. B. Narawade ...

CORAM :

S. G. MEHARE, J.

DATE :

05-08-2022 PER COURT :- 1.

Heard the learned counsel for the applicant and the learned APP for the respondent/State.

2.

The allegations have been levelled against the applicant that he is the person involved in chain snatching. There are around eight similar cases to the discredit of the applicant. 3.

The learned counsel for the applicant submits that out of eight cases, in two cases the applicant has been acquitted. It has been alleged that the applicant from the motor bike snatched the golden ornament of the complainant and fled away.

931-ABA-950-22.odt 4.

The learned APP would point out that there are eight crimes already registered against the applicant and during the investigation it was transpired that the applicant was a culprit. Since there are many similar crimes against the applicant, the custodial interrogation of the applicant is required for recovery of the stolen articles.

5.

Considering the antecedents to the discredit of the applicant and the nature of the offence, this Court is of the view that the custodial interrogation would be the only way to find out the truth. Hence, the applicant has no case for anticipatory bail. Therefore, the application stands dismissed.
