The learned advocate for the appellant submits, on instructions, that the appellant desires to withdraw this appeal in view of the changed circumstance viz. social status of the prosecutrix and renew his request for regular bail before the Trial Court based on such change in circumstance.

Considering the above and being a peculiar case wherein, the appellant requests that further details about change in the social status of the prosecutrix be not recorded in this order, that this Criminal Appeal is disposed off as withdrawn and we, therefore, grant liberty to the appellant to renew his request for regular bail before the Trial Court by citing such

Since we had appointed Shri Kulkarni, learned advocate, to represent respondent No.2 and as he had responded in this matter by preparing himself within 48 hours, his fees are quantified at Rs.3000/- (Rupees Three Thousand) to be paid by the High Court Legal Services Sub-Committee, Aurangabad.
