This Court by order dated 9.7.2009 has directed the learned counsel for the petitioner to obtain instructions as regard to the status of the proceeding filed by the respondent regarding claim for maintenance and so also, Hindu Marriage Petition. 2.

By way of this writ petition, the petitioner has challenged the order dated 13.7.2007 passed by the learned Civil Judge S.D., Kopargaon below Exh.9 in Hindu Marriage Petition No.23/2006 granting thereby maintenance pendent lite. It appears from the record that the proceedings in HMP No.23/2006 are not stayed by this Court. It appears that the cause for filing the present writ petition has rendered infructuous due to passage of time. 3.
