Mr. Patil, the learned counsel for the petitioner states that, the respondents have withheld the result of VIII semester exam of the Pharmacy course of the petitioner only on the ground that validity certificate is not submitted. The learned counsel submits that, the validation proceedings are almost at the concluding stage. The hearing has also taken place. The petitioner has paid full fees as that of a open category candidate. 2.

Mr. Tele, the learned counsel for the respondent No. 3/Committee on instructions states that, the Committee would

2 wp 7063.15 decide the said validation proceedings within one month. 3.

We have also heard the learned counsel for the university. 4.

Considering the fact that, the petitioner has paid full fees as that of a open category candidate as contended by the petitioner and validation proceedings are still pending with the Committee, it would be inappropriate on the part of respondents to withhold the result of the petitioner.

In the light of the above, we pass the following order. 6.

The respondents shall declare the result of the petitioner's VIIIth semester examination of the Pharmacy course and shall give the documents as sought. The petitioner will not be entitled to take benefit of reservation till his validation proceedings are decided. The petitioner will be bound by the judgment delivered by the Committee with regard to reservation. The writ petition accordingly is disposed of. No costs.
