1) Notice. Learned Additional Public Prosecutor waives notice. Call Record and proceedings from the Court of the Judicial Magistrate and the paper book from the Sessions Court returnable on 21st August 2015. 2) The learned counsel for the petitioner has argued on the application filed for suspension of

2 Cr Revision 120/2015 substantive sentence. The petitioner is convicted and sentenced for offence punishable under section 326 of the Indian Penal Code. After dismissal of the appeal by the Sessions Court the petitioner has surrendered to bail bonds and it is submitted that he has been behind the bars since 4-7-2015. Submission is also made that entire fine amount is deposited. It appears that the petitioner was on bail during hearing of the appeal.

3) In view of these circumstances, Criminal Application No.3689 of 2015 filed for suspension of substantive sentence is allowed. The substantive sentence is suspended. The petitioner is to be released on bail on his furnishing PR and SB of Rs.15,000/-.
