After arguing the matter at quite some length, learned advocate for the respondents on instructions, fairly states that respondents may not have any particular resistance to adducing secondary evidence in respect of the documents referred to under application Exhibit-43 as appearing on page 19. 2.

Since the respondents resiled to concede to the request under the application Exhibit-43, it may be pertinent to allow the same.

Having regard to aforesaid, without entering into merits of the matter, impugned order in the present writ petition stands

{2} wp7497-16 set aside, application Exhibit-43 shall be deemed to have been allowed. Writ petition allowed in terms of prayer clause "C". 4.
