Learned Counsel appearing for applicant insurance company submits that since the counsel appearing for the appellant was busy in another court, could not attend the present matter and consequently, it has resulted in dismissal by the court for want of prosecution. Learned Counsel undertakes to take all prompt steps to proceed with the matter. 2) In view of the submission so made, delay of 129 days caused in filing the present application is condoned. The order dated 22.1.2016, whereby the appeal stood dismissed for default, is hereby re-called. The appeal stands restored to its original file.
