Mr. Boinwad, learned counsel for the appellant seeks leave to place on record the written communication dated 23-08-2022 received from the appellant. Leave is granted. Written communication is taken on record and marked 'X' for identification.

Mr. Boinwad, learned counsel submits that the Investigating Officer has filed the charge-sheet before the concern court. In view

(2) criapl528.22 of this development the appellant may seek similar relief before the concern court and that's why he intends to withdraw this appeal with liberty to file it depending upon the fate of application for bail.

Mr. Borulkar, learned counsel for respondent No.2 and learned APP have no objection.

Having regard to the submissions of both the sides, the appeal stands disposed of as withdrawn with liberty to the appellant to file afresh depending upon fate of the matter before the concern court.
