After hearing the learned Advocate for the petitioner, when disinclination is shown by this Court to grant any relief to the petitioner, he seeks withdrawal of the petition with liberty to approach learned Additional Chief Judicial Magistrate, Ahmednagar for making an application for discharge of applicant under Section 239 of the Code of Criminal Procedure, 1973.

In view of the fact that the learned Additional Chief Judicial Magistrate, Ahmednagar has discharged some of the co-accused persons,

Cri.WP_981_2022 there is no hurdle in granting the liberty that has been prayed. The petition stands withdrawn with liberty to the petitioner to make an application under Section 239 of the Code of Criminal Procedure and the learned Additional Chief Judicial Magistrate, Ahmednagar to consider it on its merits.
