Heard learned counsel for the applicant, learned APP for the State and learned counsel for the victim. 2.
The applicant is seeking bail in Crime No.261 of 2023 registered with Sangamner City Police Station, District Ahmednagar for the offence punishable under Section 307, 323, 504 r/w 34 of the Indian Penal Code.

The applicant assaulted the wife who is a lawyer. The incident happened out of suspicion. She has been discharged. They have a small child of three years. The victim, a lawyer consciously given no objection to grant the bail as her daughter is unwell and needs the help of the applicant. That apart, the material investigation has been completed. It seems to be a family dispute arising out of
19-ba-928-2023.odt (2) some suspicion. Therefore, no purpose would be served keeping the applicant behind bar. Hence, he deserve bail on certain conditions. Hence, the following order :
ORDER
(i) Bail Application is allowed.
(ii) The applicant, Santosh Vitthal Jadhav, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.
(iii) The applicant shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet.
(iv) The applicant shall not cause harm to the injured and her daughter and shall take care of both of them. (v) The applicant shall not involve in a similar crime. (vi) Criminal Application No.2182 of 2023 is allowed. (S.G. MEHARE, J.) Mujaheed//
