Heard Mr. Karpe, learned counsel for the applicant and Mr. Borulkar, learned APP for the State. 2.

Present Criminal Application is filed under section 438 of the Code of Criminal Procedure for grant of anticipatory bail in connection with Crime No. II44/2017, registered with MIDC Police Station, Ahmednagar, for the offences punishable under sections 3/25 and 7/25 of the Indian Arms Act.

From the contents of the First Information Report, it appears that the informant received a secret information that one person by name Vinod Vikas Kothambire, R/o Jeur Bayjabai was possessing country 1/2

17ABAppln3080.odt made Pistol (Katta) and he was standing along with his Bullet Motorcycle. It has been further alleged that considering the gravity of the information, Police went there. They found Vinod Kothambire standing there with his bullet motorcycle. Upon search of Vinod, country made revolver was found in his possession. Muddemal i.e. Bullet motorcycle, country made revolver, one mobile and three live cartridges were recovered from Vinod.

Considering the above, custodial interrogation of the present applicant is not needed. In such circumstance, the applicant can be enlarged on anticipatory bail. Hence following order:

O R D E R

i.

In the event of arrest of the applicant in connection with Crime No.

II-44/2017, registered with MIDC Police Station, Ahmednagar, he shall be released on bail on his executing P.R. Bond of Rs. 5,000/- [Rs. Five thousand only], with one solvent surety in the like amount.

ii.

Criminal application disposed of.
