By order dated 22.4.2019 this court (Coram : V.K. Jadhav, J.) has disposed off the bail application No.128 of 2019 fled by this applicant as withdrawn. It is also observed in the said order that the judge of the trial court has assured to this Court that he would proceed with the trial of the case as expeditiously as possible. Application came to be disposed off without granting any further liberty to the applicant to move the trial court or this Court.

It appears that in terms of the assurance given as recorded in the order dated 22.4.2019 in BA No.128 of 2019, the learned Judge of the Trial Court has commenced with the trial and even prosecution has examined four witnesses. Learned counsel for the applicant by referring the examination-in-chief of those witnesses has vehemently pointed out the defciencies and infrmities in the prosecution evidence. The trial court is now seized with the matter and it is for the trial court to appreciate the evidence on its own merits. It is not expected from this Court to interfere and make certain observations when the trial court is seized with the matter. There is no reason to entertain this application. Hence, following order.
