The learned Advocate for the Applicant states on instructions that the Applicant has been arrested yesterday. As the Application has now become infructuous in view of the subsequent developments, he would pray for withdrawn the same. 2.
The learned APP has placed on record the communication from the EOW, Nandurbar which confirms the arrest of the Application. 3.
The same is taken on record and marked 'X' for identification. 4.
Permission granted. Application is dismissed as withdrawn. 5.
He would further submit that the matter is already settled between the Applicant and the Informant.

For such reasons and in the facts and circumstances, once the appropriate Application is filed before the Sessions Court, only on such ground of settlement, the Sessions Court may consider early hearing of the Bail Application as and when filed, considering the position of its docket on such date.
