The learned counsel submits that the petitioner had filed an application on 29.08.2018 to start a new Ayurvedic Medical College. The said application was filed well within the prescribed time. However, the said application is returned in original without the demand draft. The learned counsel submits that no reasons are given for not considering the said application. Only those applications as directed by this Court are considered.

Mr. Deshpande, the learned A.S.G. submits that a policy decision has been taken not to consider the applications for start of Ayurvedic Medical College for the academic year 2019-2020. It is only, 1/2

136wp 7969 19.odt if the Court directs, the respondents have considered those applications and that too on its own merits.

Certainly, the application of the institution for starting new Ayurvedic Medical College has to be considered on its own merits. The respondent has to consider whether the institute complies with all the requirements and no deficiencies exist.

As other applications are considered by the respondent authority pursuant to the directions of this Court, the respondents shall consider the application of the petitioner for start of new Ayurvedic Medical College for the academic year 2019-2020, in case, the same is permissible under the rules and regulations of the respondents. The respondent shall also consider, whether it is permissible to issue permission as on this date. All the aspects are required to be considered by the respondents authorities on merits. 5.

Writ Petition is disposed of. No costs.
