The applicant is seeking bail in Crime No.189 of 2023 registered with Amalner Police Station, District Jalgaon for the offence punishable under Section 395, 397, 341, 504, 506, 427, 120(B) of the Indian Penal Code.

The complainant had two stories. Firstly, he raised suspicion over the relatives of one lady who had suspicion over him of having illicit relationship with the said lady. Hence, they looted his money. However during the course of investigation, the story has been changed and it has been alleged that the present applicant was working with him. He was knowing everything about him. Hence, he was knowing that the complainant will be carrying Rs.2,00,000/- to pay to his father; hence, he with his unknown associates robbed Rs.2,00,000/- from him.

The story has been suddenly changed. Only Rs.20,000/- has been seized from the complainant. Since the so-called robbers had covered their faces, there is no possibility of identifying them. After all, the applicant has been arraigned as an accused only on suspicion. Nothing is to be recovered from him. There are no antecedents to his discredit. Hence, he deserve bail. Hence, the following order :
ORDER
(i) Bail Application is allowed.
(ii) The applicant, Avinash @ Sonu Devendra Tayade, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.
(iii) The applicant shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet.
(iv) The applicant shall not leave the place of his residence without the intimation to the Amalner Police Station. (S.G. MEHARE, J.) Mujaheed//
