On earlier two occasions, the application has been withdrawn. First bail application was withdrawn as C.A. report was not on record. On production of C.A. report before this Court, the Court had expressed disinclination to grant relief. The second bail application was, therefore, withdrawn. As such, the change in the circumstance thereafter is the passage of time and non commencement of trial only. The purpose would be served by requesting the trial Court to expedite hearing of the case. It is informed that the charge has already been framed.

In the given circumstances, the bail application stands disposed of with request to the trial Court to conclude the trial within eight months from the date of receipt of copy of this order. If the trial could not be concluded within time frame for no fault of the applicant, he is at liberty to move for bail before the trial Court. The same shall be decided on its own merits.
