The learned Counsel for the petitioners submits that the present petition is rendered infructuous in view of the fact that the suit itself is dismissed in default for want of prosecution. He further submits that since the present petition arises out of the interim proceedings before the Trial Court during the pendency of the suit, and that the suit is now dismissed, the petition no longer survives for consideration. 2.
