PER COURT :- 1) Heard. The petitioner is objecting to order passed by Assistant Registrar, Co-operative Societies, Beed, returning the proposal submitted by the petitioner-society to open Bank Account and to grant permission for registration of the proposed society and scrutiny of the proposal tendered by Respondent No.4-society. It is observed that the proposal tendered by the Respondent no.4 society was at earlier point of time compared to the proposal tendered by the petitioner society. It is not a matter of dispute that the area covered under the irrigation tank is to the extent of 43 hectares and as such, only one society can be permitted to carry on fishing activities. 2) We do not find any inconsistency, perversity or unreasonableness in the action taken by the Assistant Registrar in forwarding the proposal of the Respondent No.4society for its registration. The writ petition does not deserve consideration and stands rejected.
