Heard Mr. Joydeep Chatterjee, learned counsel for the applicant and Mr. S.B.Joshi, learned A.P.P. for respondent.

In the first information report, dated 18.3.2017 it is alleged that informant was instructed by truck owner Abdul Karim Abdul Latif to carry the cattle of Shaikh Nasir Mohammad by truck to Loni, District Ahmednagar. On the way, truck was obstructed by 7-8 persons by Indigo car and motor cycle, where these persons informed them that those persons belong to Bajrang Dal and the applicant in fact slapped and threatened the

informant to kill and snatched amount of Rs. 25,000/- from informant and took the truck to Dondaicha, Nandurbar and demanded Rs. Five Lacks from the owner of the said truck. The owner of the said truck gave Rs.90,000/- through one Qureshi.

During the course of argument, Mr.

Chatterjee, learned counsel points out the earlier communication between Director, Goshala and police. From the said communication dated 16.3.2017, it appears that present applicant caught hold vehicle MH-43/F-7258 loaded with ten bulls suspected to be taken for slaughtering and the vehicle was brought to the police station. The very contents of communication go to show that present applicant on suspicious circumstances had brought the vehicle to the police station along with bulls.

From the communication, dated 17.3.2017 it was communicated to the Chairman of Arihant Goshala that the bulls were illegally carried in the vehicle and necessary action has been taken against the concerned.

On this background, the first information report came to be registered against the present applicant on 18.3.2017.

Looking to the nature of allegations, nothing is to be recovered from the possession of the applicant.

In such circumstances, the applicant can be protected from his arrest. Hence, the following order.

Criminal Application is allowed.

Ad-interim protection granted by this Court to the applicant by order dated 23.6.2017 is hereby made absolute.

Criminal Application is disposed of.
