1] Pursuant to order dated 02.11.2020, learned APP submits that as per the instructions provided by the Investigating Officer, statement of accused no.1 has been recorded. She submits that there is no specific instructions provided about recording of statement of applicant - accused. She further submits that the Investigating Officer has informed that the investigation is in progress and charge sheet will be filed within statutory period.

2] Learned counsel for the applicant seeks permission to withdraw the application with liberty to file fresh application before the Sessions Court after completion of

Learned counsel submits that in case charge sheet is not filed within statutory period, the applicant will exercise option to seek default bail.
