Heard the learned counsel for the applicants, the learned A.P.P. for the respondent/State and the learned counsel for the complainant.

The applicants have been arraigned as an accused for a fraud played with the complainant factory. It has been alleged that the applicants have siphoned money by illegal means. They have cheated the sugarcane factory.

The auditor has determined the liability of each of the applicants. As per the proposal, the applicants have deposited the amount of their liability with the learned trial Court. The public money has been secured. The applicants are languishing in jail for sufficient time. The material investigation has been completed. Their custodial interrogation is not required. Considering the progress in the investigation and bona fide of the applicants depositing the money, the auditor determined, the Court is of the view that the bail may be granted to the applicants. Hence, the following order :- i) The applications are allowed.
ii) Applicant - Bandu s/o. Bhanudas Gungare in B.A.No. 1073 of
2022, applicant - Namdeo s/o. Dhondiram Tattu in B.A.No.1868 of 2022, applicant - Ganesh s/o. Jija Neel in B.A.No.1810 of 2022 and applicant - Gajanan s/o. Shantaram Chepate in B.A.No.1933 of 2022, be released on bail, on furnishing PB and SB of Rs.1,00,000/- each, with one or two solvent sureties of Rs.50,000/- of the like amount each, in C.R.No.119 of 2022 registered with MIDC Paithan Police Station, District Aurangabad, for the offence punishable under Sections 406, 409, 464, 468, 471 read with Section 34 of the Indian Penal Code, on the conditions that, (a) They shall not tamper with the prosecution witnesses. (b) They shall co-operate with the investigation and attend the court regularly for trial on each date of material hearing.
iii) Criminal Application Nos. 2472, 3746 and 3745 of 2022 are disposed of.
