The claimants and their counsel Mr. R.D. Thorat are present. The learned counsel Mr. D. V. Soman along with Mr. Indrees Khan, Assistant Manager, present on behalf of respondent No.3/ Insurance Company are present. The respondent No. 1 and 2 and their counsel remained absent.

With the assistance of the learned counsels, we have ascertained identification of the appellants and representative of respondent No.3. They affirm the terms of the settlement.

Present appeal instituted by the claimants, claiming enhancement of compensation. The appellant submitted that on 16.08.2022, the Member, Motor Accident Claims Tribunal, Ambajogai, District Beed passed the impugned order and granted meager amount of compensation of Rs. 3,00,000/- (inclusive No Fault Liability amount) with interest @ rate of 7.5 % per annum from the date of petition till its realization.

On inquiry, the Assistant Manager of respondent No.3, initially agreed to pay additional compensation amount of Rs. 2,00,000/- ( Rupees Two Lakhs only) and after due negotiations with the claimants and the Assistant Manager, it has been agreed to pay additional compensation of Rs. 2,25,000/- ( Rupees Two Lakh Twenty Five Thousand) inclusive interest, which may be full and final amount of settlement.

Respondent No.3/ Insurance Company agreed to deposit an additional compensation of Rs. 2,25,000/- ( Rupees Two Lakhs Twenty Five Thousand only) within a period of eight weeks from today before this Court. After the amount is deposited, the claimants will have
(3) liberty to withdraw the same in equal apportionment through father and mother. The appellants/claimants agreed to accept the same. In view of the above, the First Appeal stands disposed of. 6.
Pending Civil Applications, if any, also stand disposed of. 7.
Award be drawn up accordingly.

The parties are informed that the Court fee, if any, paid by any of them shall be refunded.
