The first appeal is filed by the claimants for enhancement of compensation granted by the motor accident claims tribunal along with application for condonation of delay of 220 days. 2.

The learned counsel submits that the applicants did not have sufficient knowledge of law and because of which the applicants could not file the said appeal within a period of limitation and they are given meager compensation and also their rights would be defeated in the event, the delay is not condoned. The applicant after

2 ca 8646.2023 discussing with the advocate realized that they have a right to challenge the order. As such, the first appeal is filed with a delay of 220 days. The delay caused is not intentional and is bonafide. For the reasons stated, the delay of 220 days is condoned. The civil application for condonation of delay is disposed of.

Issue notice to the respondents in the first appeal, returnable on 18.10.2023.
