We have heard the learned Advocate for the petitioner and the learned APP on behalf of the respondents.

We find that the petitioner's application seeking emergency parole under Rule 19(1)(C) of the Maharashtra Prisons (Mumbai Furlough and Parole), Rules, 1959 in the light of the circular of the State of Maharashtra dated 08/05/2020, has been filed on 04/08/2020 and is pending.

In view of the above, this petition is disposed off with a direction to respondent No.2 to decide application dated khs/Oct.2020/1341

- 2 - 04/08/2020, if not already decided, as expeditiously as possible and in any case on or before 02/11/2020. We have not expressed any opinion about the merits of the application and the same shall be decided strictly in accordance with the rules and the circular dated 08/05/2020.
