I have heard learned Counsel for the applicant for some time.

Learned Counsel for the applicant submits that though the applicant, by order dated 11th August, 2020, in B.A. No.454/2010, was granted liberty to fle application for bail before the trial Court in the event the trial is not completed within six months from the date of regular commencement of court functioning. After the withdrawal of bail application herein, the applicant has preferred this bail application for bail on the principle of parity since this Court, by order dated 13th September, 2019 in B.A. No.1077/2019 and connected matter,

{2} ba127220.odt has released the applicants (co-accused in this crime) on bail. This Court has expressed disinclination to release the applicant on bail by applying the principal of parity, as the case of those applicants is on diferent footing.

The learned Counsel, thus, on instructions, seeks leave to withdraw this application. The learned Counsel submits that however, the liberty, as granted by earlier order dated 11th August, 2020, that may remain continue.

Leave granted. The application is disposed of as withdrawn.

It appears that the regular Court functioning has now commenced. In view of the same, in the event if the trial is not completed within six months, the applicant would be at liberty to fle an application for regular bail before the trial Court in terms of the order dated 11th August, 2020.
