Challenge in this petition is to the order dated 12 June 2019 passed by the Chief Executive Officer (CEO), Zilla Parishad, Parbhani. Perusal of the said order shows that petitioner was initially placed under suspension in contemplation of departmental enquiry. However, by the said order, the petition was reinstated subject to the outcome of the department enquiry and was posted at Panchayat Samiti Sonpeth.

The learned counsel for the petitioner submitted that the petitioner is aggrieved only by the posting of the petitioner at Sonpeth which was at a place different than his initial posting.

Learned counsel for the petitioner pointed out that the departmental enquiry was eventually conducted/concluded and penalty of debarring the petitioner from one annual increment was imposed upon him. Subsequent to this, the petitioner has retired from service on 31 December, 2021.

In that view of the matter, there is no occasion for us to examine the challenge to the said order to the extent of posting the petitioner at Sonpeth. The petition is accordingly disposed of with no order as to costs.

Needless to mention that we have not examined any other issue pertaining to the departmental action taken against the petitioner.
