IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.9512 OF 2018 (Chanchalbai Kashinath Batche Vs. Sangamabai Ganpatrao Batche and others) Mr.A.N.Barhate Patil, Advocate for the petitioner. ( CORAM : Ravindra V.Ghuge, J.) DATE : 04/09/2018 PER COURT :

1.

I have heard the learned Advocate for the petitioner. A statutory remedy by filing a second revision u/s 257 of the M.L.R.Code is available to the petitioner in view of the law laid down by the Hon'ble Apex Court in the matter of Gurudassing Nawoosing Panjwani Vs. State of Maharashtra [2015(6) Mh.L.J.915]. 2.

This petition is, therefore, disposed of with liberty to the petitioner to prefer the second revision before the State on or before 28/09/2018. If the revision is filed on or before 28/09/2018, the time spent by the petitioner in this Court from 11/07/2018 till the passing of this order would be a good ground for condonation of Kranti Hansraj Shekatkar delay. The petitioner is at liberty to file an application for interim relief alongwith the revision and the revisional authority would consider the same on its own merits.
