The applicant is seeking regular bail in Crime no.74 of 2016 registered at Satara Police Station, Dist. Aurangabad for the offences punishable under section 3/25 and 7 of the Arms Act, section 135 of the Bombay Police Act and under section 34 of the Indian Penal Code.

The applicant was arrested on 18/3/2016. The investigation in the matter is complete and the chargesheet is already filed. Apart from offence under section 7 of the Arms Act, rest of the sections, are informed to be bailable one. So far as offence under section 7 of the Arms Act is concerned, under section 25(1-AAA) of the said Act, the same is punishable with 7 years.

While trying to make out a case for grant of bail, Shri Bhosale would urge that in absence of any criminal antecedents and the fact that the investigation in the matter is already over, the applicant is entitled to be released on bail. 5.
Shri Mahajan, learned A.P.P. opposed the application on the ground that if released on bail, since the applicant is resident of the adjoining State, there is every likelihood of his absconding from the trial.

Having bestowed thoughts to the submissions made, it will be appropriate in my opinion to order release of the applicant on bail, particularly, having regard to the fact that the investigation in the matter is complete and the chargesheet is already filed and there are no criminal antecedents. 7.
The Application, as such stands allowed.

The applicant be released on bail in Crime no. 74 of 2016 registered at Satara Police Station, Dist. Aurangabad for the offences punishable under section 3/25 and 7 of the Arms Act, section 135 of the Bombay Police Act and under section 34 of the Indian Penal Code, upon his executing P.R. bond in the sum of Rs.25,000/- (Rs. Twenty Five Thousand) with two sureties in the like amount. Shri Bhosale, learned counsel for the applicant volunteers that he shall furnish two local sureties.

The applicant shall not tamper with the prosecution evidence or influence the witnesses in any manner.

During trial, the applicant shall cooperate with the Court below by not seeking unnecessary exemptions and shall not protract the trial.
11.
Any attempt on the part of the applicant to protract the trial, if noticed by the learned Court below, it shall be open for the Court below to issue warrant against the applicant.

Criminal Application stands disposed of accordingly.
