VERSUS
THE STATE OF MAHARASHTRA ...
Advocate for Applicant : Mr. Rane Girish S.
APP for Respondents/State : Mrs. P.V. Diggikar ...
CORAM : S.S. SHINDE & MANGESH S. PATIL, JJ.
DATE :
10.10.2017 P.C. :- .
Heard the learned counsel appearing for the applicant and the learned A.P.P. appearing for the State. We have carefully perused the averments in the application. Delay in filing the appeal has been satisfactorily explained. It is true there is inordinate delay of 580 days in filing the appeal, however, length of delay is not important but the explanation offered by the applicant is plausible. In that view of the matter, the application is allowed and the same stands disposed of. 2.
Issue notice to the respondent, returnable on 15.11.2017. Learned A.P.P. waives service of notice on behalf of respondent-state. [MANGESH S. PATIL, J.] [S.S. SHINDE, J.] mub
