1] Heard counsel for the applicant. Perused the grounds taken in the application and also the notes of evidence, and in particular, Dying Declaration at Exhibit 58. Upon perusal of the contents of the Dying Declaration, prima facie, we are of the view that the finding recorded by the trial court, appears to be sustainable. We are not elaborating further on the evidence since the appeal is pending for consideration. Suffice it to say that there is sufficient evidence. No case is made out for interference in the application. Application stands rejected.
