Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No. 0108 of 2024 registered with Himayatnagar Police Station, District-Nanded for
the offence punishable under Sections 392, 395, 341 read with Section 34 of the Indian Penal Code.

Applicant has a case that though the first informant states that there were only four accused, the investigation officer has added his name of another accused. He would submit that socalled property has been shown to be recovered from the applicant, but in fact it was not recovered from him. Applicant has been falsely implicated in the crime. There are no antecedents at his discredit.

Learned APP would submit that stolen property has been recovered at the instance of the applicant. Applicant and his associates committed two consecutive crimes of the same nature. Hence he does not deserve bail.

Applicant is the first time accused in the crime. He is 21 years old. So-called stolen property has been recovered. The trial may take its time. Therefore, his detention would serve no purpose. Hence the following order:-
O R D E R
i) Bail Application stands allowed.
ii) The applicant - Pandurang S/o Yashwant Suryawanshi be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in the above crime, on the condition that:- (a) The applicant shall attend the concerned police station every Monday between 10.00 am. to 2.00 p.m., till filing the charge-sheet.
(b) The applicant shall not involve in the similar crime.
