Application filed by the petitioner for issuance of caste certificate is rejected. Appeal is also dismissed. 2.

It appears that the application and appeal of the petitioner are dismissed only on the ground that the petitioner has not produced document prior to 1950.

We have time and again held that only because a candidate could not produce document prior to 1950, would not be sufficient to negate the claim, if the other documents substantiate the caste of the applicant.

In the light of the above, the impugned orders are quashed and set aside. The Sub Divisional Officer, Bhokar shall consider

2 wp 2875.22 application of the petitioner on the basis of documents produced by the petitioner and take decision upon it, on its own merits, in accordance with law, expeditiously and preferably within a period of eight (08) weeks from the date of appearance of the petitioner. The petitioner shall appear before the Sub Divisional Officer on 13.03.2022.

In view of the above, the writ petition is disposed of. No costs.
