DATE : 24TH DECEMBER 2014
(2) W.P. No. 6610 of 2011 COURT'S ORDER (Per B.P. Dharmadhikari, J.) :
1.
Adv. Mr. Bharad on behalf of the petitioner is seeking time to take necessary further steps.
2.
Adv. Mr. Dighe appearing for respondent no.5 invites attention to prayer clause. However, he fairly submits that he has no specific instructions on facts.
3.
The learned Assistant Government Pleader has also invited attention to prayer clause.
4.
Prayer clause is to direct respondents, to hold meeting of Managing Committee for the purpose of election of Chairman and ViceChairman of respondent no.5 - District Central Co-operative Bank, Parbhani.
5.
Petition has been filed on 10th August 2011. It is, therefore, apparent that by lapse of time, the challenge cannot survive. 6.
However, if for any reason, the said meeting has not been held, and the very same Managing Committee is in office even today, we grant petitioner, leave to move appropriate representation to respondent nos.3 and 4 for the said purpose.
7.
If such representation is moved within three weeks from today, said respondents shall consider it, in accordance with law, within
(3) W.P. No. 6610 of 2011 next four weeks.
8.
With these directions and keeping all rival contentions open, we dispose of the Writ Petition. No costs.
