Mr. Sonwane, the learned Counsel for the petitioner submits that the petitioner had qualification of 10th Std. at the time, he was appointed as an Assistant Teacher. His appointment as an Assistant Teacher is prior to 1972. The learned Counsel relies on the Government Resolution dated 04.10.1983 to contend that as per the said Government Resolution, the petitioner is being a trained teacher and the pay scale of trained teacher is applicable to him. This Court has also held accordingly. 2.

The learned Counsel further submits that the name of the petitioner has been taken in the list of the persons entitled to

{2} 39-WP-8149-18 be paid as per the pay scale applicable to the trained graduate teacher.

In case, the name of the petitioner is taken in the list by the respondent for payment of salary being trained teacher, then the respondent may take decision on in accordance with law. The pension shall be given to the petitioner as per the pay scale applicable to the trained teacher as per the Government Resolution dated 04.10.1983.
