The petitioners were initially given posting orders. They applied for the change of place of posting.

The petitioner No. 1 was given posting order at Pimpri Chinchwad, applied for the change of posting. The petitioner No. 2 is given posting at Ahmednagar and petitioner No. 3 is recommended for giving posting at Zilla Parishad, Jalna. 3.

The learned Counsel for the Zilla Parishad submits that there are no vacancies available with the respondents. The same appears to be position with Zilla Parishad, Aurangabad. The Zilla Parishad, Ahmednagar is not before us as is not made party.

Considering the anomalous situation, the Director of Education (Primary) shall consider the vacancies available with the respective Zilla Parishads and shall take decision with regard to the posting of the petitioners at a particular Zilla Parishad on its own merits. The same shall be done expeditiously and preferably within a period of two months from today.

The Writ Petition is disposed of. No costs.
