Heard learned advocates for the parties.

It is being referred to that having regard to circular dated 24th April, 2017 issued by Joint Secretary, Revenue and Forest Department, Maharashtra Government, the so called delegation of powers to Additional Collector under circular dated 25th May, 2015 has been withdrawn, so far as election disputes of Gram Panchayat are concerned.

Learned advocates are ad idem that the impugned order has been passed by Additional Collector.

Having regard to aforesaid, it appears that the parties have

{2} wp7850-18 no particular resistence to send the matter for consideration to Collector. Impugned order accordingly is set aside. Matter filed by the respondent is transferred to Collector, Osmanabad. 5.

It is reported that next date before Additional Collector is 2nd August, 2018. In the circumstances, if petitioner intends, the petitioner may file reply as early as possible before the Additional Collector by said date, however, proceedings as a whole be transferred to Collector, Osmanabad. It is expected that parties would co-operate. Collector to proceed with the matter as expeditiously as possible and dispose of the same preferably within a period of six weeks from the date of receipt of writ of this order.
