1] Learned counsel for the National Highways Authority, submits that the amount as awarded by the Arbitrator has been deposited in this Court by virtue of the orders passed by this Court. The High Ways authority has filed an application under Section 34 of the Arbitration and Conciliation Act, wherein, stay has been granted. In the light of that, writ petition is disposed of.
2] As per the orders of this Court, amount is deposited by the National Highway Authority same be transmitted to the District Court, Dhule, where the application filed by the National Highway Authority under Section 34 is pending. The petitioner is at liberty to make an application before the District Court for withdrawal of the amount, which application shall be considered by the District Court, on its own merit.
