The petitioner claims that he is entitled for the benefits of Assured Career Progress Scheme ('ACPS' for short). The grievance of the petitioner is that claiming the said benefits of the ACPS he had submitted the representation dated 15.12.2016, Exh. E, before respondents, but the same has not been considered.

Having regard to the aforesaid, we are inclined to dispose of the petition by directing the competent authority of the respondents to consider and decide the representation of the petitioner keeping in view of the law laid down by this Court in the case of Sitaram Gaja Rathod and Ors. Vs. The State of

WP No. 9988/17 Maharashtra and Ors. in Writ Petition No. 8441/2014 decided on 7th October 2014 and also the decision given by the Division Bench of this Court at Principal Seat at Bombay in Writ Petition No. 2358/2013 decided on 21st September 2013.

Let the decision as aforesaid be taken by the competent authority of the respondents within three months from the date of receipt of copy of this order. In case, the petitioner is found entitled to the benefits of the ACPS, the same be also extended to him within the aforesaid period. 4.

With the aforesaid directions, the petition is disposed of.
