After having heard the learned Counsel appearing for the applicant and the learned Counsel appearing for the respondent, the following order is passed.

ORDER

(i) The applicant is permitted to withdraw 50% of the deposited amount with interest accrued thereon subject to submit an undertaking to the satisfaction of the Registrar of this Court. The balance 50% of the amount along with the interest accrued thereon be invested in Fixed Deposit Receipt in any Nationalized Bank initially for the period of one year, and if so required till disposal of the appeal.
