The petitioner is stated to be deserted wife of respondent No. 4 who is a pensioner. She is aggrieved by the nominating his sister to receive the retiral benefits. The petitioner seems to have moved employer with representation dated 21.10.2019 seeking a declaration about her right to have family pension and also a direction for appropriating her maintenance through the amounts payable to him.

Admittedly, respondent No. 4 has retired on 31.07.2013

911wp8767.21 and by now must have received the retiral benefits. So far as the family pension is concerned, it would be the matter which cannot be pre-judged.

There is no merit in the petition. The petition is dismissed. Needless to state that the petitioner would have her remedies else where.

Civil Application is disposed of.
