Applicant apprehends arrest in connection with with C.R. No. 24 of 2022 registered with Jintur Police Station, Dist. Parbhani for the offences punishable under Sections 328, 272, 273 of the Indian Penal Code and Sections 26(2)(iv), 27(3)(d), 27(3)(e), 30(2)(a), 59 of the Food Safety and Standards Act.

Learned Counsel for the Applicant submits that co-accused against whom similar role is alleged is enlarged on anticipatory bail by this Court in ABA/221/2022. It is his contention that now chargesheet is filed and hence, custody of the Applicant is not necessary.

Admittedly, investigation into the crime is over with filing of the charge-sheet. Contraband articles are seized at the time of raid itself. Coaccused is granted anticipatory bail. There is no reason to deny the parity. Hence, application is allowed in terms of interim order dated 03rd July, 2023. (R. M. JOSHI, J.) Malani
