The petitioner is praying for quashing and setting aside the proceedings bearing Criminal Application No.1807/2018 (Abdul Gafur Mira Pathan Vs. Shahabuddin Husain Pathan), pending before the learned Judicial Magistrate First Class, Aurangabad. The said proceedings are in respect of proceedings under Section 156(3) of the Code of Criminal Procedure for offence punishable under Sections 420, 464, 468 of the Indian Penal Code.

Since the proceedings of 2018 have sought to be quashed in this petition and this petition is filed in 2019 and since then, it was never circulated or listed before this Court. It seems that the petitioner is not vigilant or alert and this Court cannot come to aid of such litigants, who are sleeping over their rights. Even otherwise
