Sharad Vasant Thakur v. The State Of Maharashtra And Others
W.P.9643/2017
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
BENCH AT AURANGABAD WRIT PETITION NO.9643 OF 2017 Sharad s/o Vasant Thakur ..Petitioner
Versus
The State of Maharashtra and ors.
..Respondents Mr T.M. Venjane, Advocate for petitioner Mr K.N. Lokhande, A.G.P. for respondents no.1 to 3 Mr S.S. Manale, Advocate for respondent no.4 CORAM : S.V. GANGAPURWALA & A.M. DHAVALE, JJ DATE : 2nd February 2018 PER COURT 1.
Petitioner seeks directions against respondent no.4 to delete the remark "cancelled" on the order dated 29th April 2017. 2.
We have heard learned Counsel for the parties. 3.
The petitioner earlier filed Writ Petition No.1512 of 2009. The said writ petition is disposed of under order dated 21st April 2009. This Court in the said order observed that if the Committee upholds the tribe claim of the petitioner, then respondents no.2 and 3 shall correct the record without requiring further orders from this Court. It was directed that the entry regarding caste of the petitioner be corrected as "Hindu Thakur" (Scheduled Tribe), if the Committee issues validity certificate to be petitioner.
4.
It appears that the petitioner is subsequently issued with the validity certificate on 7.2.2011.
5.
Considering the above, th Education Officer had rightly passed the order of directing correction in the school record, however,
W.P.9643/2017 subsequently has endorsed the same as "cancelled". The said endorsement appears to be improper.
6.
In view of that writ petition is allowed in terms of prayer clause (B). No costs.
