Heard learned counsel for the applicant, learned APP for the State and learned counsel for the complainant/injured. 3.

The applicant is seeking bail in Crime No.232 of 2023 registered with Gangapur Police Station, District Aurangabad for the offence punishable under Section 143, 147, 148, 149, 307, 324, 323, 504, 506 of the Indian Penal Code.

The injured and the applicant have adjacent the fields. There was a quarrel over breaking a bandh. Both sides have lodged the reports and persons from both sides were injured. There were

933-ba-1077-2023.odt (2) cross complaints against each other. The allegations against the applicant are that he assaulted one Yogesh Walture with iron rod. However, he had suffered simple injury. Considering the role attributed to the applicant and the nature of injuries sustained at his hands and recovery of the alleged weapon, it would be inappropriate to keep the applicant behind bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Jitendra Shahadrao Hadule, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet.

(iv) The applicant shall maintain law and order in Village Nevargaon, Taluka Gangapur, District Aurangabad. (v) Criminal Application No.2469 of 2023 is allowed. (S.G. MEHARE, J.) Mujaheed//
