2] The learned counsel for the respondents submits that the petitioner-plaintiff has withdrawn Regular Civil Suit No.20/2009, with liberty to institute a fresh suit in respect of the same subject matter. In view of the same, the interim order passed by the Civil Court in Regular Civil Suit No.20/2009 would be rendered infructuous. The learned counsel has placed on record copy of the order dated 04.02.2023 passed by the Jt.Civil Judge Junior Division, Jafrabad in RCS No.20/2009 and the same is taken on record.
